They reposessed my car from my address 3 years ago. I never received paperwork that it was being auctioned, or to repurchase the vehicle. My ex husband states he has been informed that he will be sued for the $12,800. they were unable to collect from the sale. I have never received anything. If the bank had my physical address to reposess the car then why (If what my ex-husband sates is true) did I not receive paperwork of the suit. This is a credit union in California and I have been told they they have different guidelines and laws than for example: Bank of America. Is this true and is this legal.

I have a court date for November 16th for driving an uninsured vehicle. I got into an accident with a car i bought from an auction but no one else was envolved. I missed my last trial date and they put a warrant out for me. Eventually they caught up to me and threw me in jail for 3 days for contempt of court. November 16th is my rescheduled trail date. I am so broke and was wondering do you still think it was be a good idea to get a lawyer?

We are going to court soon, we were served papers of Civil Summons in regards to a vehicle loan we defaulted on. They repossessed the vehicle and sold it at auction and we are to pay the amount we owe, as I understand and as we should.

My question is, they have not asked for a list of assets, we don’t have many, a paid for truck and a small savings. We haven’t filed for bankruptcy and aren’t likely to. My husband is the sole income earner and is head of household, his taxable income was less than $20K this year.

When I spoke to the filing attorney after I received the summons, he said that they will speak to me after the judgment in court and arrange a payment plan.

Since they did not request a list of assets will they take our savings and truck? Or are they likely to entertain the payment arrangement as long as we hold good on the payments? What will happen?

If they haven’t asked for a statement of assets – do they know about it?
We do have a house – would they simply put a lien against that? Since the house is valued at 92K and we owe 63K?
Our payments didn’t come from our bank account.

I recently was playing on a web-based game this weekend. I wanted to purchase an ‘enhancement’ to my character on the game (the enhancement was digital by the way). The enhancement cost $55. I decided to modify the paypal button code to $0.01 and see what happens. Sure enough, I got the enhancement and only paid a penny.

A few days later, after racking up a total of 5 pennies, the owner of the site emailed me – talking about a ‘fraudulent charge’. He told me I had 2 days to send him $181.00! So, I was obviously shook up. I am only 16, I didn’t have the money.

I knew I was not in the right there.

But, relentless as I am, I decided to investigate paypal’s TOS.

“11.4 What are the eligibility requirements for PayPal seller protection?… …The item must be a physical, tangible good that can be shipped.”

“11.9 What are examples of items/transactions that are not eligible for seller protection?… …Intangible items, licenses for digital content, and services”

“The Seller Protection Policy does not cover Claims for Significantly Not as Described or for non-receipt of merchandise, or sales of intangible goods, services, or licenses for digital content.”

“Claims must be for payments for tangible, physical goods that can be shipped, and not all other payments, such as payments for intangibles, for services or for licenses and other access to digital content. For purposes of eBay items, motor vehicles and Live Auctions are not covered.”

So, I ask, am I going to be charged by paypal and make my bank account go into the negatives, and do who knows what else?

The way I see it, even though I triggered it, if his website gave me goods that I didn’t pay for and doesn’t check for that kind of thing, it’s not my fault.

I understand the moral issues here, and can say that never again will I pull such a stunt. But, that is not what I’m asking. I am asking: What can this seller do to me?

This really needs an answer, as I believe this is cops overstepping thier bounds by leaps. Apparently they can arrest you, and take your vehicle, and sell it at auction, leaving you to still pay for it with your auto company. What the fuck do these officers think they are doing, fucking someones life completely over for a responsible adult wishing to enjoy a PLANT!!!! This didn’t happen to me, but I saw it on an episode of COPS.

A towing company towed the vehicle, sold the vehicle at public auction for less than the towing and storage charges, and failed to notify me within the time limit that they allotted me for payment
